The games are currently free of charge. Should we offer paid content in the future, prices, billing and refund terms will be displayed before purchase and will form part of these Terms.

TO THE FULLEST EXTENT PERMITTED BY LAW, OCEANFUSION LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

12. Indemnity

You agree to indemnify and hold harmless OCEANFUSION LLC from any claim, loss, liability or expense (including reasonable legal fees) arising out of your breach of these Terms or misuse of the Service.

13. Suspension and Termination

We may restrict or end your access to the Service at any time if you violate these Terms. Provisions that by their nature should survive will continue to apply after termination, including Sections 5, 10, 11, 12 and 14.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Missouri, USA, without regard to conflict of law principles. Any legal action relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Jefferson County, Missouri, or the federal courts for the Eastern District of Missouri, and you consent to their jurisdiction. Before starting any legal action, you agree to contact jackbertjohnson57609@hotmail.com and attempt to resolve the matter informally for 30 days.

15. Changes

We may modify these Terms from time to time. The revised Terms will be posted on this page with an updated date. Continued use of the Service after the changes become effective means you accept them.
